SITE TERMS AND CONDITIONS

These Terms of Use constitute a legally binding agreement between you, whether personally or on behalf of an entity (“you”) and Noble Real Estate Signs, a DBA of Noble Pest & Termite LLC (“NRES”, "Company", “we”, “us”, or “our”), regarding your access to and use of the www.noble-res.com website, as well as any related media, mobile websites, or mobile applications (collectively, the “Site”). By accessing the Site, you agree that you have read, understood, and accept all of these Terms of Use. IF YOU DO NOT AGREE, YOU ARE NOT AUTHORIZED TO USE THIS SITE.

We may post additional terms or documents on the Site from time to time, which are incorporated by reference. We may update these Terms at any time, and your continued use of the Site constitutes acceptance of any changes. It is your responsibility to review these Terms periodically.

The Site is intended for users who are at least 13 years old. Minors (generally under 18) must have parental or guardian permission to use the Site.

INTELLECTUAL PROPERTY RIGHTS

Unless stated otherwise, all content on the Site—including source code, designs, graphics, text, images, videos, and signage-related materials (collectively, the “Content”)—and all trademarks, service marks, and logos (the “Marks”) are owned or licensed by NRES and protected by U.S. and international intellectual property laws.

You may access and view the Content for personal, non-commercial use only. You may not copy, distribute, reproduce, modify, or use any Content or Marks for commercial purposes without our express written permission.

USER REPRESENTATIONS

By using the Site, you represent and warrant that you:

  1. Have the legal capacity to accept these Terms;

  2. Are not under the age of 13, or have parental permission if a minor;

  3. Will not access the Site through automated or non-human means;

  4. Will not use the Site for illegal or unauthorized purposes;

  5. Will not violate applicable laws or regulations;

  6. Will provide accurate, current, and complete information.

Providing false or incomplete information may result in suspension or termination of your access.

PROHIBITED ACTIVITIES

You may not use the Site for purposes other than those authorized by NRES. Prohibited activities include:

  • Collecting user information for unsolicited communications;

  • Advertising or selling products/services not authorized by NRES;

  • Circumventing security features of the Site;

  • Uploading viruses, malware, or harmful code;

  • Harassing, impersonating, or defrauding other users;

  • Reverse engineering or copying software or code;

  • Using the Site to compete with NRES or for unauthorized commercial purposes;

  • Using the Site in ways inconsistent with applicable laws.

MOBILE APPLICATION LICENSE

If you access the Site via a mobile app, we grant you a revocable, non-exclusive, non-transferable license to use the app on your devices. You may not:

  • Reverse engineer, modify, or copy the app;

  • Use it for unauthorized commercial purposes;

  • Share it with multiple users without permission;

  • Send automated queries or spam.

Apple and Android users must also comply with the terms of the respective App Store or Google Play.

SUBMISSIONS

Any questions, feedback, or suggestions you submit regarding the Site (“Submissions”) become the property of NRES. We may use them for any lawful purpose, commercial or otherwise, without compensation or acknowledgment.

PRIVACY POLICY

Your use of the Site is subject to our Privacy Policy, incorporated herein by reference. By using the Site, you consent to the collection, storage, and processing of your data in the United States. Users under 13 must have parental consent.

TERM AND TERMINATION

These Terms remain in effect while you use the Site. We may suspend or terminate your access at any time without notice or liability. You may not create new accounts to circumvent termination.

DISCLAIMER AND LIMITATIONS OF LIABILITY

The Site is provided “AS IS”. NRES disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. To the fullest extent permitted by law, our liability is limited to the amount paid by you to us in the six (6) months prior to any claim.

INDEMNIFICATION

You agree to defend, indemnify, and hold NRES harmless from any claims, damages, or expenses arising from your use of the Site, your Submissions, or your violation of these Terms.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by Texas law. Any disputes shall be resolved by binding arbitration under AAA rules, except for intellectual property or injunctive relief claims. If arbitration is unenforceable, disputes will be resolved in Fort Bend County, Texas courts.

MISCELLANEOUS

These Terms, together with any other policies on the Site, constitute the entire agreement between you and NRES. If any part of these Terms is found unenforceable, the remainder will remain in effect. There is no partnership, employment, or agency relationship created by these Terms.
